Agreement to Terms

By accessing or using the services provided by Ekaa Pitch ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms apply to all visitors, users, and clients of our services.

Description of Services

Ekaa Pitch provides professional consulting services including but not limited to:

• Investor pitch deck design and consulting
• Business plan development
• Corporate presentation design
• Fundraising advisory services
• Financial modeling and analysis
• Strategic consulting for startups and SMEs

Client Responsibilities

As a client of Ekaa Pitch, you agree to:

• Provide accurate and complete information necessary for our services
• Respond to requests for information and feedback in a timely manner
• Make payments according to the agreed-upon terms
• Use our deliverables only for their intended purpose
• Not misrepresent our work as your own creation to third parties
• Comply with all applicable laws and regulations

Intellectual Property Rights

Our Materials: All content, templates, frameworks, and methodologies developed by Ekaa Pitch remain our intellectual property. We grant you a non-exclusive, non-transferable license to use deliverables created specifically for your project.

Your Materials: You retain ownership of all content, data, and materials you provide to us. By sharing these materials, you grant us permission to use them solely for the purpose of providing our services to you.

Portfolio Rights: Unless otherwise agreed in writing, we reserve the right to display completed projects in our portfolio and marketing materials, with appropriate anonymization of confidential information.

Payment Terms

• Payment terms will be specified in your project proposal or agreement
• Unless otherwise agreed, an advance payment is required before work begins
• All fees are non-refundable once work has commenced, except as specified in our refund policy
• Late payments may incur additional charges and delay project delivery
• Prices are subject to change for new projects without prior notice

Confidentiality

We treat all client information as confidential. We will not disclose your business plans, financial information, or other sensitive data to third parties without your consent, except as required by law. We may require clients to sign a separate Non-Disclosure Agreement (NDA) for projects involving highly sensitive information.

Limitation of Liability

To the maximum extent permitted by law:

• Our services are provided "as is" without warranties of any kind, either express or implied
• We do not guarantee specific outcomes such as funding success, investor meetings, or business results
• Our total liability for any claims arising from our services shall not exceed the amount paid for the specific service in question
• We are not liable for any indirect, incidental, special, or consequential damages

Disclaimer

While we strive to provide high-quality consulting and design services, we make no representations or warranties about the accuracy, reliability, or completeness of our services or any investment or business decisions made based on our work. Our services are intended to assist with presentation and communication, not to provide financial, legal, or investment advice. We recommend consulting with qualified professionals for such matters.

Termination

Either party may terminate the service agreement under the following conditions:

• By mutual written agreement
• If either party breaches these Terms and fails to remedy the breach within 14 days of notice
• If a project is cancelled by the client, payment for work completed up to that point is due
• We reserve the right to suspend or terminate services for non-payment

Revisions and Modifications

The number of revision rounds included in each project will be specified in your project proposal. Additional revisions beyond the agreed scope may incur extra charges. Major scope changes may require a new proposal and additional fees.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in India.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
